They don't even deserve one star. Previous to 2/7/22, they had me in arrears even though basic math showed I was not. My attorney had to include in my stipulation to zero out all prior arears, which my EX even agreed was justified. It took a court order and attorney fees to fix. Now, not only did they not fix the arears, they added more since 2/7/22 when a new order was issued and failed to readjust my payment down to what the court order states June. Numerous phone calls have failed to get this handled. The people who answer the phones there are useless. A case worker has yet to call me. I filed a complaint and even that went nowhere. They are eager to send you threatning letters about being in arrears but fail to fix the issue due to thier own incompetence and negligence.

File a motion packet from Sheriff Office, but all Fines must be paid and account current. Might grant you the motion but Judge wilk not render judgement. If this makes any sense. Hope everything works out.
You need to go down there and ask for enforcement.
Start by verifying that the funds are on account at Child Support. You may need to file a Motion with the Court to Compel Turnover of those funds.

You have to go to the Child Support Agency, Rm 101. They will be able to help you get that started.
You can go back to court any time there is a "substantial change in circumstances". (Change in income is one.) Milwaukee County does not waive filing fees if you file on your own. They only waive if you are low income. You have to appear before a judge to get the waiver signed, otherwise the fee is $30 for child support only.
When you file your Motion for Modification of Support, specify clearly what you believe his income to be, including sources. Pro-tip: go to the Clerk of Courts and purchase three Subpoenas. Prepare them as subpoenas for documents; ask each source to detail payments/wages paid to the NCP (Nom-Custodial Parent) for the preceding 12 Months. have the Sheriff serve them on the sources of the income in question. If you are indigent, go to the Chief Judge’s Office, and request a fee waiver for service. You will need to advance witness fees or document fees for each of these payers, however....if you can figure out how to follow my directions, you’ll be very happy with the results!

Yes she is right. Than they have to track the Father of your children down, Sheriff will subpoena him for court. So that you two can go and see a judge and have him set your monthly child support payment.

If you want to help her out give them money through child support and always document keep receipts whatever else you spend on your child so the next time you go into court you have a paper trail and proof if you borrow money or give money do it in a money order keep the stubs
if you owe arrears you still owe it. If she waives arrears then only arrears balance goes away. Your current child support order would still be in effect monthly.

Who is she living with? If the mom is on state aid, report her to the welfare office. If she's getting benefits for the child she may get them cut off or have to prove the child is living with her. If there is a support order against you you can file a motion to get it stopped. Investigating fraud isn't what child support does. They're basically a collection agency for the courts.

Talk to the free legal clinic first. Get their advice. Otherwise, you need to file a Motion to Modify. Explain your financial situation. The forms are downloadable on CCAP's website. After you fill out the forums, you'll have to make 5 copies, then file the motion on the 1st floor, Clerk of Court office, pay any filing fees, then go to room 707 to get a hearing date (get it on the commissioner's calendar). Even if he was paying Double Child Support,,, Far as him not paying child support just go down to the Court House and go to the child Support division and they will put a warrant out for his arrest and bring him in front of a judge and if he is working they will take child supportout of his check if he isn't working they will make him go find a job or go to jail immediately!!
Do not call - appear in person, and ask to vacate any default against you. You may have to fill out a Motion and show good cause for having missed the hearing. The sooner you go, the better off you are.
You need to file a URESA Petition in Milwaukee County Circuit Court to have your child support case transferred. Be aware - if you moved out of state without the permission of the Non-Custodial Parent, that could come back to visit you... Go to the Self Help Desk at the Milwaukee County Courthouse for the appropriate paperwork.
Is your son over 18? If so, he has to sue her for determination of paternity, and he should file an affidavit of paternal interest ASAP in case she gets into trouble with Child Welfare. If he’s under 18, this will need to be pursued by a Guardian ad Litem on his behalf. Make sure that he requests genetic testing as part of his paternity case. Where did she have the baby? That is the appropriate venue for the paternity suit.
No it will not. Debt remains owing case. You can fill out an application to reopen case to try and collect on debt. Statute of limitations to collect on a debt with child support is 38yrs old. Once child on case is 38yrs old we will no longer try to collect on it.

You can have arrears discharge but you still have to pay R&D fees and birth expenses. In Milwaukee County you have go to the Courthouse with a valid ID and fill out paperwork in person and make 3 copies of the paperwork and have two stamped envelopes ,then it goes to the judge to get approved or denied you will receive the decision in the mail. I just did it a couple of months ago. As far as paperwork getting sent to another state I don't know.
