The Company Played a game with the check. They used two different color ink so I couldn't cash the check. The Labor Commissioner's cashier should have been more observant. She saw the issue copied the check and gave it to me. I had to make the #BWWLA issue another check. They were sore loosers!

You can go into a local office and file a wage claim. Go to dir.ca.gov and check locations to find the closest one to you. Bring copies of any proof and paperwork. You can even download and fill out the initial wage claim form from the website and submit it to the office. I don't know if wage claims will be accepted by mail, but it does not hurt to try

In regards to meal and break periods, it depends on the industry. But typically, you are entitled to a 10 min paid on the clock break every 4 hours. For work that is over 6 hours, employers must provide a 30 min uninterrupted break period that must be taken before the fifth hour of work. That is the minimum requirement, and they do not have to have a lunch break anything over that.

You are entitled to two 10 min rest periods for every 8 hours worked and one 30 min meal period within 5 hours of the time you start. Yes you can file a wage claim for rest and meal periods for the entire year you worked for that employer. You will claim 1 hour of pay for rest period and 1 hour of pay for meal period for every day you worked and were not allowed to take those breaks.

It also depends if they consider you an Independent contractor. I don't think they have to give you health insurance or vacation, but sick time should be offered.

Before Jan 1, 2019, CA minimum wage was $11/hr. Now it is $12/hr. Azusa is an incorporated city in Los Angeles County and does not have a seperate minimum wage set. For example, companies in the city of Los Angeles have a minimum wage of $13.25. Basically, starting Jan. 1st, 2019, your minimum wage became $12/hr. It is not legal. You can file a claim for your wages.

Management can't put their hands in your tips/take any money from it. But they can do things like splitting it with other servers :/. So I'm not sure what you mean by discounting them.

What you have to do is go to Labor Commissiob and file a Complaint personally, there they will provide you with a form that you must fill out and submit right there, no matter your immigration status because there are labor laws that protect all people, but first of all you must to tell you very well what happens with those checks of the people who do not manage to collect, pay them later or simply lose their money, if there are several employees in that situation or all .... make a list of the people affected ... Pass the report to the Labor Commission and file a Class Action Lawsuit ... believe me they will help you and get all your wages back. Do it soon there are terms of time.

File a wage claim for overtime violations. You can only claim 3 years back. By law, your employer has to provide you a W-2 if you're an employee or a 1099 if you're an independent contractor so that you can file your income taxes every year. You can also file Report of labor law violation at www.dir.ca.gov if they do this to all of the employees.

Normally, If you give your employer 72 hours notice that you're quitting then you must get paid on your final day of work. If you don't, then they must pay you within 72 hours from the day you quit. Visit dir.ca.gov and type in "final payment" for more detailed information.

Not legal. They need to pay out all of your vacation the day you quit. If you gave them less than 72 hour notice, they have 72 hours to pay you all of that (unless you agree to letting them mail it). They should not be interrupting your lunch either. I would recommend you file a wage claim with the labor commissioner, or try to find an attorney.

In your case, the employer is required to give you all owed wages including vacation time (but not sick time) on your final day, because you gave them over 72 hours notice. You will be able to collect waiting time penalties for up to 30 days from your final day.

You can mail your form to ; The Labor Commissioner's office 320 West Fourth Street, Suite 450 Los Angeles, CA 90013 If it is an existing case, please include your name, case number, etc. Note : if Los Angeles isn't your local office, it might take longer to process

It depends if you were working and which counties you drove through because different locations have different minimum wage requirements. In some cases, the employer might not be required to pay at all, but I would still encourage you to file a claim form.

It depends on the city and county you are in. Currently for 25 employees and less, it is 10.50 per hour. For 26+ it is 11 an hour
