I was changing lanes and got rear ended. The insurance co, Geico is trying to tell me that it is my fault. They are telling me that if the person is maintaining his lane and I come into his lane and he hits me, that is my fault. Is this correct??

No way is that your fault! I’m MD if you get rear ended it’s NEVER YOUR FAULT. It’s an insurance law in MD. I’ve been rear ended 4x over the years (starting to think I have a target on my car lol) My mom has been an insurance agent for 30yrs in MD. You can switch lanes and go faster/slower, that’s not an excuse for them hitting you from behind. Call your insurance company and let them deal with it

If you are a Maryland resident and the accident occurred in Maryland then I would ask that you put your concern in writing and send it to the P&C complaints Division of the Maryland Insurance Administration.
