Don't call ACS. They will just kill it. If you want the dog to be removed from your neighbor please find a shelter that the poor dog will have a chance at or someone who wi foster or adopt. The dog deserves a chance
yes talk to the neighbor. if it can't be resolved peacefully between you and new neighbor, contact Animal control services at 211. it's also possible the dog is just scared cause he / she is new there also and a few days adjustment will settle it down.

Did you check if the Dog has Food & Water plus Shade. If nothing of them call 311 and report. But if the Dog barks all Night too you can call 311 too.
Is there an HOA? If so, get with them of not, I'd suggest you send them an anonymous letter and ask them to please try to remedy the situation so no more action is needed. Good luck.
