Are you two in the domestic partnership? do you have his name on your child's birth certificate? have that as proof that you are family also get proof that the order protection was dropped so you can present it at DHS most likely to send you to Nova
Only if you have proof that the order of protection is closed....you have to have proof for NOVA. Also he needs to be on your sons birth certificate if not y'all should have domestic partnership papers
