I have a building located in the Bronx we have a Certificate of Occupancy that indicates on of the floor as a public eating and assembly place...how can I get that changed since it is no longer a place of Assembly.

You have to file for a new C Of O so it can meet the purpose of usage. It must meet the regulations required for the change intended. If you don't you will be fined. Once this is done it will be inspected to see if compliance is met. Also, if it's your intention to convert it into a place of residence it will have to meet HMC (Housing Maintenance Codes, & MDL Multiple Dwelling Laws). Last but not least you should look into zoning regulations to see if your purpose is acceptable for where this property is.
