If theres no shelter then it could possibly be animal cruelty.
The dog has a shelter but I don't know if it's insulated. And obviously his water must be frozen. I can't see thru the hedges but when we WERE speaking I saw the dog house. He was in horrible living conditions, a kennel filled with trash and feces, previous to being allowed to roam in the backyard. He owner says his dog bites.
