The vehicle needs to be in its original configuration in order to pass smog check. You can check the under hood label, and if it lists 'Catalytic' or CAT or TWC, then your vehicle requires a catalytic converter and therefore it must have one to pass inspection.

You'd have to ask them, but if it is supposed to have one then no. It may also qualify as exempt.
