How do I know what type of Bankruptcy I need to consider. Most of my dept is old and has been sold from firm to firm. 100% of my dept is personal, not professional. It's a ton of small things primarily. Thanks!

The type of Chapter you should file (if any) is dependent upon a lot of different factors, such as: 1). Amount of Disposable Monthly Income; 2). Amount of Exempt/Not Exempt Assets; 3). Types of Debt (i.e. Priority vs. Non-Priority and Secured vs. Unsecured); and 4). Goals (i.e. if you need to stop a repossession or foreclosure and/or merely want to wipe out unsecured debt). Therefore, without knowing # 1-4 above, we shouldn't advise you on what Chapter to file. However, in order to determine if you qualify for a bankruptcy and/or what if any Chapter of the Code you should file under, we provide all prospective clients with a Free Consultation to determine your income, assets, debts, and issues/goals. During that free consultation, we then use said information to determine your best plan of action and discuss your options. Therefore, please call our office to set up a free consultation to discuss your options. We can get you in anytime from M-F 9am - 6pm.
