Found the office of Inna Fershteyn on Google. Have to thank you Google for a great advise. Great trust and planning lawyer. Explained everything down to the last number. It was unexpected honest answer from a lawyer who should be making money of a client, yet gave me the best advise and solution which saved me time and money. Give her 5+ stars.

Because of changing circumstances, I needed expert estate planning advice. Through my research and referrals, one name kept popping up - the Law Office of Inna Fershteyn and Associates, PC - so I made an appointment. During a very pleasant interview, Ms. Fershteyn delved into my desires and intent, while explaining the reasons for each question. After discussing several alternatives, Ms. Fershteyn determined that a revocable trust together with a living will plus power of attorney were best suited to accomplish my present goals rather than a last will and testament. (No other attorney had presented me with that alternative.). Ms. Fershteyn carefully and fully explained how each instrument operated and patiently answered all questions. In addition, Ms. Fershteyn introduced me to and arranged for a complimentary consultation with David Gulyamov, wealth manager with GGW Financial Group, to discuss methods of funding the trust and alternative investments. I was so impressed with Ms. Fershteyn's legal advice and service that I brought another person with me to consult with her after I executed my trust. I am writing this review on behalf of my parents who used this Trust and Estate Planning Law office to set up Revocable Living Trust, Will, Healthcare Proxy, Power of Attorney and transfer of their Brooklyn house into a trust. My parents were retiring and needed to put their affairs in order and I reserved to google to see who the best elder care attorney is in NY. This office had the most positive reviews and I decided to give it a shot. Let me tell you guys, I was pleasantly surprised. Having dealt with attorneys for my business my entire life, I was prepared for months and months of back and forth communication and planning and a huge bill. However attorney and her team were so precise, clear and direct that my parents made a decision on the spot, gave all of their information and received complete Trust and will package from attorney within 2 weeks of time. And it was all done with very careful Corona-19 precautions. Masks were worn at all time, our temperature was checked and recorded into the book, hand sanitizer and gloves were available and office was cleaned after every client and aired out for like 30 minutes. We were really happy and safe and can not recommend this Trust and Estate Planning law office high enough.

Do I need a lawyer to make up a will for my mother?

Yes of course you need a Lawyer to make a will see NY wills Jane very specific execution and witness requirements where 2 witnesses need to be present and most importantly only attorney can notarize a will. NY and Kings county surrogates court has a very bad and prolonged probate process. It literally takes over 12 months to probate the will in NY. By statistics 1/3 of all wills are thrown out of probate (Surrogates Court proceedings) as they were executed or witnesses incorrectly! And with 50% of all wills being contested you really don’t want to take a chance that what you wrote yourself won’t stand in court. Moreover you are an interested party and a beneficiary of the will and will be accused of “undue influence” on Testator if you write a Will yourself. I hope I answered your questions and you will take my advise and NOT Execute self-written will!

Dear Natalia, If you have just one bank account you may not need a trust or even a will done. What you can do is add a Designation of Beneficiary form to your bank account appointing a person who will receive all your assets if you are not here. I do, however, recommend that you put together a Living Will and Healthcare proxy for medical decisions (designating someone as your Health care representative in the even of incapacitation) and a Power of Attorney (designating someone to make financial decisions in the event of incapacitation).
