I am privileged to be in charge of my mother's affairs as she is in now in an assisted living situation. Attorney Shurden was recommended to me by my bank as an Elder Lawyer who could aid me in protecting her assets. Attorney Shurden offered a opportunity to come in for a free consult. During this visit I found him to be very knowledgeable regarding Elder Law and able to allay any concerns. There was no need to change anything that had been previously implemented. If your dad has been found to be incapacitated by a Guardianship Court and a Guardian has been appointed, then the Guardian has the power to determine your Dad's place of residence. If there has been no court finding of incapacity then whoever your Dad named as health care surrogate will probably be making the decision about placement. And if your Dad had not named a health care surrogate while he had capacity then Florida's default health care proxy statue is where you can go to identify who can make health care decisions for your dad. That Florida statute is 765.401. Google it and see where you stand.
No Sorry. My initial consulations are working meetings during which I do a detailed intake and then provide you with as much practical information as I can. Giving half-baked advice before knowing the details is malpractice. I ask that the client be prepared for the meeting by having income and asset information available. During our discussion I will prepare a spreadsheet and use it to explain how different asset protection strategies would apply to your situation. I type some notes for the client and quote a fee if there is additional work to be done.
