Walt Shurden was highly recommended to our family at a pivotal moment in our Mom’s rapidly declining health. He was able to help us navigate the the best financial path forward for our mother’s care while at the same time allowing us to focus on spending critical time needed with our Mom as we rallied to nurse her back to health. It was very clear to us, this is not just Mr. Shurden’s job, caring for the elderly is truly his passion. He exceeded our expectations and ultimately helped transition our Mom to Medicaid which assured she would be given the medical care she needs for the remainder of life. Walt Shurden is exactly the guy you want to talk to for advice on how help your parents. He did not steer me toward engaging his services in a paid capacity at this time. He did give me lots of great advice and some leads on where to go to help my mother deal with Medicaid, assisted living, trusts, etc. He was very gracious and generous with his time and his counsel. I'm glad I called him.

I am privileged to be in charge of my mother's affairs as she is in now in an assisted living situation. Attorney Shurden was recommended to me by my bank as an Elder Lawyer who could aid me in protecting her assets. Attorney Shurden offered a opportunity to come in for a free consult. During this visit I found him to be very knowledgeable regarding Elder Law and able to allay any concerns. There was no need to change anything that had been previously implemented. If I find any need to make any adjustments I would definitely seek his advice..

Can I get my dad out of nursing home and reverse incompetency?

If your dad has been found to be incapacitated by a Guardianship Court and a Guardian has been appointed, then the Guardian has the power to determine your Dad's place of residence. If there has been no court finding of incapacity then whoever your Dad named as health care surrogate will probably be making the decision about placement. And if your Dad had not named a health care surrogate while he had capacity then Florida's default health care proxy statue is where you can go to identify who can make health care decisions for your dad. That Florida statute is 765.401. Google it and see where you stand.

No Sorry. My initial consulations are working meetings during which I do a detailed intake and then provide you with as much practical information as I can. Giving half-baked advice before knowing the details is malpractice. I ask that the client be prepared for the meeting by having income and asset information available. During our discussion I will prepare a spreadsheet and use it to explain how different asset protection strategies would apply to your situation. I type some notes for the client and quote a fee if there is additional work to be done. The fee is $300.00 for the initial one hour consultation and it is applied toward the total fee for the engagement. Thank you for your question. Walt Shurden
