Yes, absolutely. For example, if you own your vehicle free and clear (no loan) you can protect it in a bankruptcy case. If you are still making payments on your car, you can continue paying for it. After filing bankruptcy you keep the same vehicle contract you had before you filed bankruptcy. That means your monthly car payment, interest rate and contract length stays the same. On the other hand if you feel like you cannot afford your car payment you can give it back through the bankruptcy. Some of our clients return their car vehicle because they owe a lot more than the car is worth. After filing bankruptcy you can purchase another vehicle immediately. Many lenders will finance a vehicle the same day a bankruptcy case is filed. By filing bankruptcy you are no longer carrying burdensome debt. Consequently, vehicle lenders see you as a good candidate for a new loan. To sum up, you can keep your vehicle whether you own it free and clear or you are paying payments.
