Yes for the safety of the kids but don’t sign anything because that will keep the hold longer at least that was for my experience and Chisago county. From my experience in Ramsey County CPS does a great job at actually keeping the kids safe and communicating with the parents.

People talking about a warrant are referring to entering your house, not the actual hold. They also do not need a warrant to ever a house if they believe there is an immediate danger to someone inside the house. As someone who has dealt with CP, I can tell you they most certainly have that right to remove your children and put them in a house of their choosing.

^^ wrong. They need a warrant

Nick Drea | Oct 31, 2019

Yes then they have 72 hours I believe to give your children back or have a court hearing

That's an uneducated BS answer. There is no state or federal government agency which is allowed to operate outside the binding check and balance of our Constitution. The 4th amendment applies and CPS may intimidate you but they are required to obtain a warrant to enter your home, unless they manipulate you into consent. Push the issue and never give consent, your odds of winning in court are much higher if they break the law.

I would consult a lawyer. CPS workers do not have to tell you any of your rights before coming into your house or taking children as opposed to police who must legally do so before arresting you. You may very well have rights to an appeal process that they dont tell you or just plain dont want you do know about

Yes. If CPS has cause (some evidence that your kids are in danger or being neglected) then they are able to act incredibly quickly and decidedly in the interest of the children.
