I'm being sued by a debt collector for a credit card debt. I'm 76 yr. old & my only Income is Social Security. Under Federal Law Social Security is exempt of collection. The DC knows this but trying to collect. What RIGHTS do I have under NM Law?

Send them a validation letter. Google it. They have to reply 30 days w contract. If you have no contract w them they have to take their collection off credit report and cease harassing you or pay a fine to you.

The only time your SS income can be garnished is if it is Education or Child Support debt.
