The relevant statute is Section 42-4-239, C.R.S. Nate Grimm is correct that the fine is $300 for a first time offense unless texting causes bodily harm, in which case is it is punished differently. This statute also states the officer must see the use of the cell phone occur "in a manner that caused the operator to drive in a careless and imprudent manner."
