If the store won't refund or exchange then contact nike directly, they have a very accommodating return process, you send in the shoes with the claim number you receive after filing the damage claim, they assess your complaint and issue a voucher. That's what I did when buying air max from shoe carnival because their return/exchange policy is horrible. Jcpenney is usually VERY good about their return/exchange process. I've never had an issue with jcpenney- they've always been great.
I would call the store and talk to them.
