RCHD does not conduct mold inspection nor do environmental mold sampling. If the root cause of the moisture infiltration and accumulation is known and if it is due to defects in building structures, plumbing, and/or HVAC system, then the property owners are responsible for repairing the problem and controlling the moisture factors ASAP. Under residential rental situations, the local building maintenance inspectors should be contacted if landlords or their agents fail to respond and address building-related defects that led to the mold growth in a reasonable and timely manner. In Virginia, mold problems in rental units are covered by the VA Residential Landlord-Tenant Act and it is essentially a civil matter (between the landlord and the tenants) and not a regulatory matter. Therefore, a tenant may need to seek legal advice to resolve the conflict.
