You will need to consult an attorney for this question. In some circumstances, no you don't really to probate. In other you might to. Really an attorney would be able to answer.

It's called Will for Safe keeping. There is a small fee and the clerk's can help you. Friendly and helpful! The lady named Jayme helped me safekeep my will. Very easy, I think it was maybe $12. They have their fees on their website-Probate Clerks.
