Filled Surrogate Court paperwork months ago…no call back…no letter in the mail…paperwork was thoroughly completed…no one in the clerk’s office even bothers to return phone calls or even emails…I live in another state and the court system is handled way more professional that this system but I guess this is how they treat people of color in the Bronx

In my profession as a virtual Trust & Estate paralegal, I communicate with New York State Surrogate's Courts nearly daily. The clerks at this court are very pleasant and helpful and are goal oriented in moving files forward. Backlog happens, vacancies happen but I believe that the Clerks at this court (in particular Ms. Thompson and Robert in the Administration Department) are exceptional.

EXTREMELY SLOW.. if you need to go here bewarnd it will take at least 4 months before you get your first response from them. And if you need an ammendment letter be prepared to wait another 3 to 4 weeks.. if you need to see the cashier here make sure you do it before 1pm if not you need to wait till 2pm for they only seem to have 1 or two cashiers there. If you need to see the help desk do it before 1pm if not you will need to wait till 2pm. And now that it is summer time good luck for certain people you may need to sign off on your paperwork may be on Vacation.

Court you go to because the deceased person died with no will but the person has legal heirs.
It depends on what is "the process" you're asking about. Covid has slowed everything down, as you know; otherwise the Surrogate's Court system in New York operates efficiently. The laws and rules in New York regarding decedent's estates are detailed and specific, and the surrogate (the judge) and the clerks must make certain all paperwork is filed and correct. And, even after a Will is admitted to probate, which could take weeks or months; once in a while more than a year, there are a lot of steps which come afterwards. The executor handles those tasks and the court is not involved at all.
I work for the Bronx Supreme Court. You have to have her death certificate and prove who you are. Did she have a will in place. It's first come first serve. Get there before the kids get there. And claim beneficiary before the state takes it and it will be filed under unclaimed property.

To be honest I would strongly suggest you contact the Public Administrator 718 293 7660 or Bronx Surrogate Court 718 618 2309 leave them a voice message with your name and phone number When they call you just explain your situation and perhaps they may have a suggestion

Your share, if any, is determined entirely by the will. If the decedent named you specifically as an inheritor then you are potentially entitled to what was bequeathed to you. The will does need to be submitted to the surrogate's court for the probate process to determine if the will is valid, the most recent, and appropriate under the applicable New York law. If you are entitled under the will it is highly recommended that you seek the assistance of an attorney.
