Judicial officers here will fabricate legal arguments and try to stiff you based on knowingly false legal arguments. For example, a Magistrate Judge in this court recommended dismissal based on the contention that Judges are absolutely immune from suit; however, the Sixth Circuit in Ward v. City of Norwalk held that judges can be sued for declaratory and injunctive relief under 42 USC 1983 (which is all a requested). This court also applies the outdated inextricably intertwined standard of of the Rooker-Feldman Doctrine, despite the fact that “In Exxon, the Supreme Court implicitly repudiated the circuits' post-Feldman use of the phrase "inextricably intertwined" to extend Rooker-Feldman to situations [where] the source of the injury was not the state court judgment…” [Kovacic v. CUYAHOGA CTY. DEP'T OF CHILDREN & FAM., 606 F. 3d 301 - Court of Appeals, 6th Circuit 2010] “The Sixth Circuit also repudiated the "inextricably intertwined" test used by the lower courts prior to the Exxon Mobil decision, finding that standard was no longer viable” [In re Durham, 493 BR 506 - Bankr. Court, SD Ohio 2013]. Be careful with these judges because they will mis-quote the law, use outdated or defunct cases, and generally even use cases which are no longer valid as a means to dismiss your case. I am not a lawyer and nothing in this post and nothing that I write should be construed as legal advice or legal argument. Everything in this post is merely a representation of my lay opinion.
