All the DA,s do is stack charges and give people life. The only reason I made it out of there is because my family had money to hire me a defense. I feel sorry for the people subject to Jeff Rosen and Judy Lee's prosecutorial abuse of power. I wonder how many years people are waiting on trial because DA's like Lee like to take vacations to Hawaii during people's trials instead of working with currupt cops to spread lies and build a phony case.

In short as long as one of the transactions occurs after April1 you will be eligible to transfer in accordance with Proposition 19. "Proposition 19 requires the transfer of the base year value to occur on or after April 1, 2021. It does not require that both the primary residence be sold and the replacement primary residence be purchased on or after April 1, 2021. Therefore, in most cases, as long as either the primary residence is sold or the replacement primary residence is purchased on or after April 1, 2021, the base year value of the primary residence can be transferred to the replacement primary residence under Proposition 19. However, future legislation may impact the operation of Proposition 19 and any updates will be posted on the Board’s website."

In response to your question based upon the limited info provided--in general both parent and child can sell a home and purchase a new one in the same county and transfer the property tax value as long as the parent meets the qualifications under prop 60/90. The parent has to be at least 55 years of age when the original property is sold. The original property must be eligible for the homeowners exemption and must be subject to reappraisal at its current fair market value at the time of sale. The replacement property must be the parent’s principal residence and must be eligible for the homeowners exemption and it must be of “equal or lesser value” than he original property. Also, the replacement home must be purchased or built within two years of the sale of the original property and a claim form must be file with the Assessor’s Office. Final decisions by the Assessor’s Office will be based upon the specific information provided and the above is informational only and not binding.
