Doug, In most cases, an injured party carries UM (Uninsured motorist) coverage which can be used to compensate someone who has been damaged by an uninsured driver's negligence. Otherwise, there are some cases in which another party may be held liable for a driver's negligence. For instance, if that driver was performing a task for his employer at the time of the collision, the employer may be liable. Thanks for the question. Hope that helps. Ed Casey
Helen: I take cases on a "contingency" fee basis. That means I get paid an agreed percentage only from the proceeds of a settlement. I also advance the costs of the case- obtaining medical records, copy charges, filing fees, etc. Those costs are also only recovered when the case settles. Contingency fee agreements are important because most people cannot afford to pay an attorney by the hour for a case that may take several months or even a year to resolve. Thanks for the question. While most cases take several weeks to several months to resolve, the biggest factor is the client's medical condition. Cases should only be resolved when the client is finished with medical treatment and there is a clear understanding of the nature and extent of future medical needs and disabilities. A case cannot be re-opened after it settles (except in some workers' compensation cases). So, you do not want to agree to a settlement only to find out at some later date that the client needs more treatment, or even a surgery. I hope that answers your questions. Ed Casey
