We were very fortunate to have the Musil Law firm handling my wife's immigration case. Mario Musil is extremely knowledgeable of immigration law, he is very well organized and detail oriented, and he did a great job keeping us informed and up to date throughout the process. He is also very responsive, always available to take our calls or respond to our many email inquiries concerning our case. We highly recommend the Musil Law firm if you are seeking a very competent lawyer that will work tirelessly to achieve the best possible outcome for your immigration case.

Mario has been always a professional lawyer and he was close to me and my wife during the whole process. We both are really glad to have worked with him. It´s difficult to find a person/lawyer to trust regarding personal matters and he has been always committed to helping. We worked with him in the middle of the pandemic when everything was more complicated and he always found a legal and positive solution for everything. I definitely encourage everybody to work with him if you are looking for an honest, hard worker, and professional lawyer.

My wife and I thought that we could do the immigration paperwork ourselves. Then we started looking at the documents and everything that was required and realized just how complicated a process it really is. We searched and were lucky to find Mario. He expertly guided us through a very complex process and made it look easy. While the process did take a very long time, due to Covid and the complications it caused, Mario was by our side the whole time. Any time we had a question or a concern, he was there for us. During our interview, the agent thought there was a problem, but thanks to Mario's knowledge of the law, he was able to point out that there was no issue, just a misunderstanding on the agents part. I was impressed with his knowledge of how things work in Brazil (where my wife is from) and how easily he was able to smooth out the misunderstanding. I would highly recommend Mario to anyone.

Mario represented us during our immigration process from start to finish and he was amazing! He was responsive and helpful and explained what had to be done every step of the way. He took care of all the paperwork (which I truly do not think we could have done without him). We got approved the same day of our interview! If you are looking for an immigration attorney, there is no one better than Mario!

No, you are not required to stay in the same place when you have a pending immigration matter. When you move your case may move to a different office and will continue to process there. Speak with an immigration law firm about the process to make sure you follow the proper steps.
Yes.
You can check the current processing times for the I 130 application here: https://egov.uscis.gov/processing-times/ This will give you the time frame for the initial step that is then followed by State Department processing - which is normally another 90-180 days. I normally tell applicants to expect between 9-18 months for a marriage based application process, but it fluctuates, especially due to covid and US Embassy closures. At the end of the day, the sooner you file, the sooner your spouse will be in the USA. Speak with a qualified Portland Immigration attorney to go over the process in more detail. Good luck!
Our main office is at 621 SW Morrison St Suite 1437, Portland, OR 97205 by the Pioneer Square. We are doing initial consultations remotely.
You should discuss the specifics of your situation with a qualified immigration lawyer to make sure all the requirements and qualifications are met, for example what is his current status and how long has he been here, what is your immigration status etc. If the requirements are met, generally you would submit the Relative Petition and Adjustment of Status petitions at the same time, along with the other required forms and evidence including copies of birth certificates, passports, visas, I-94, marriage licenses, divorces, sponsorship documents etc .
The requirements for Naturalization are higher than those for a green card and someone who may have successfully obtained a green card, may not qualify to naturalize, or may be denied naturalization at the discretion of USCIS. Your husband should have his records reviewed to determine if any of his charges are a complete bar to naturalization, or if they are something that can be discretionarily used to deny his application. An experienced lawyer will be able to analyze the specific charges and provide your husband with an opinion as to his chances of a successful petition.
You generally need the passport you entered with to show proof of legal entry. If it is lost, you may be able to still show valid entry through an I 94.
You mother would be an immediate relative and you can petition for her and she would not have to wait for visa availability - meaning she could be a green card holder in about a year or so (not considering Covid delays). Your brother however is not an immediate relative to you and would be subject to visa availability - for Mexico they are processing those cases from 1998. However, once your mom got her green card, she could petition for her son (your brother) under the F2a category that is current at this time - meaning it would take a year or so (not considering Covid delays). You may wish to speak to a Portland immigration attorney to come up with the best strategy for your situation.
If you apply to renew your green card, you can either receive an extension sticker on the card when you do your biometrics, or you can ask for temporary card during an infopass appointment at your local USCIS office. If you need help with renewing your green card, contact a Portland Immigration Attorney today!
If you leave the US, you will trigger the 10 year ban, preventing you from returning to the US with or without a visa for 10 years. You should speak to a Portland Immigration Lawyer to discuss the specifics of your situation
Although you may be able to prepare the petitions and go through the process on your own, submitting the petition incorrectly can lead to a denial that may have other consequences in the future. Not knowing all of the nuances involved can prolong the process and sometimes lead to minor children aging out. The process involves working with multiple agencies, including U.S. embassies that are very difficult to communicate with. An experienced Immigration Lawyer can guide you through the entire Fiance Visa process and help ensure a successful outcome at the initial visa process as well as the subsequent adjustment of status.
Yes, the unmarried and under 21 years old children of your fiance can follow their parent to the United States and also obtain a green card after the marriage takes place.
The processing times may vary depending on the country of origin of the fiance and the current workload of the various immigration departments involved. However, most fiance visas should be processed in a bout 9-12 months.
If you have friends or family members that have used an immigration lawyer and they were satisfied, start your research there. If not, look for immigration lawyers online. Be sure to check the lawyer’s license and their online reviews and reputation. Websites like avvo.com and martindale.com rate attorneys and aggregate reviews from clients, judges and other lawyers. Make sure your lawyer is a member of the American Immigration Lawyer’s Association (AILA). This helps ensure that your attorney is involved in immigration matters and is up-to-date with all of the daily changes in the law. AILA lawyers also have access to liaisons and resources that are not available to non-member lawyers and the general public. Once you narrowed down your search, meet with the lawyer and see if you “click” and are comfortable with the person – after all – this is the person whom you will have to trust with your future.
The best time to hire an immigration lawyer is at the very beginning, even before you decide you want to go forward with a visa or an immigration petition. Many attorneys offer a free consultation or one for a nominal fee. It is a great idea to determine what your options are and whether you qualify for a visa. If you do qualify for one, is it the best option for you?
Your immigration process can be one of the most important and consequential processes in your life time. It is certainly not something you want to leave up to chance. Even the smallest of mistakes can cause terrible outcomes. I often receive phone calls from people who applied on their own, and during the process the spouse has left the country for an emergency and has triggered a 3 or 10 year ban – meaning they cannot re-enter the United States for a decade. Or people who file the wrong application, or assume a child is included on the parent’s petition and waste thousands of dollars in fees, and more importantly waste months ,if not years, of not being able to live with their loved ones. Having a well respected and qualified immigration lawyer ensures that you are not depending on luck to have your case approved – instead you are doing it with the purpose of getting an approval on your petition.
