They have City workers there typically under a tent helping people in the parking lot and maintaining an illusion of order. Not sure if it's legal, but they have official entrance guards that tell you to swim safe.
It's totally legal. In fact when I was there last week on vacation they were building parking lots for tourists. The only way to get there is by parking in the residential areas on W Blount
