I may be wrong but if they sent the 3day letter and didn't follow through with the eviction then my son shouldn't be liable for breaking the lease or past months rent. Am I wrong?

Yes, you are wrong! You are still under obligation to the lease until it is up, or it is ordered by the judge! Basically if the landlord wants to go after you for the defaulted amounts, they are within their rights! I would recommend that you follow up with the lawyer's office, and find out your actual options; good luck!
