I believe your two replies are correct. (Disclaimer: I am NOT an attorney.) It the officer had a legal reason to stop/interact with you, they may investigate further suspicions. And despite how socially decriminalized it has become in recent years, marijuana is generally still an illegal drug.
I think it's reasonable to believe that they can act in the scope of their jurisdiction I don't think they can ignore a law that they believe is being violated
I am not an attorney. I think that if they smell it, it gives them reason for suspicion.
