You can take hiss interest off on the property by doing a Quit Claim Deed but keep in mind if the property is within the city of Chicago you need to prepare your transfer declarations online and your Water Certifications online too, once everything is prepared and recorded you than have total interest inn the property.

You will need to first contact your mortgage company and ask if they will "release" him from any liability for that mortgage. If they agree, then he may Quitclaim the property to you exclusively. Depending on which city the property is in, that will determine the process you will have to undertake in order to Quitclaim it from him to you. But the first step is to get permission from the lender to have him released.
