Its hard for young animals to adjust to new surroundings and it does take time, patience and love to get them to trust you... Especially if the animal is a rescue. But if its just too much and you sont want to invest in the pet, send furkids an email, i'm sure they can help.
Wow try putting some food in a catch and shut cage and drop kitty to shelter or call your nearest animal control, maybe a little more time, love and patience with kitty will helpbecause its a kitten it takes time for to adjust to you and environment
This is a place to ask about FurKids...not to directly talk to them. I would just call and ask. The kitten may be sick and avoiding the litter box. Try getting a small can of wet kitten food and just set it on the floor and sit near it. When the kitten comes to eat it, you can try to gently pet it. It may take some time, but a kitten needs to eat and have water available.
