Hello William, Great question. There’s certainly been some confusion surrounding this topic. Last December the President signed new legislation that raised the federal minimum age to purchase tobacco products from 18 to 21 years old nationwide. This raised every states age limit to 21 including Idaho, regardless of their previous state laws. What has added more confusion around this topic is that Idaho legislators recently took it upon themselves to attempt to also raise their state law to make it 21 as well, so that they could enforce this age limit at the state level. This proposed law did not pass causing some people to believe that the age had been lowered back down to 18 years old. However, the reality is that nothing changed and the federal law of 21 is still in place and still supersedes the state law as it did back in December.
