Yes, they must have a parent or legal guardian present to get their license. Also if the 16 year old did not present a birth certificate at the time a permit was issued and has a non photo permit, they must also bring a birth certificate with their parents to prove identity to get their license.

No, just needs to be able to prove that they are who they say they are. Like a birth certificate.
