In at fault states, drivers who are deemed to be responsible for an accident are liable to cover the damages for everyone involved. Washington is an at-fault state. Proving what exactly happened in your auto accident in an at fault states can be difficult without knowing what types of evidence is needed to prove fault, which can make handling insurance claims very difficult for any person who hasn’t had specialized training. This is usually never a good choice and can often become a very costly mistake. It may seem like you’re helping them out and being nice, but there may be more damages to you or your vehicle than what it initially looks like. Unfortunately, the other driver may even come back and say that you were the one at fault, which happens more often than it should. Calling the police to report the accident and alerting your insurance is always the safest, and the smartest, way to proceed. Yes, you are able to sue your own insurance company. If you were injured in an auto accident and the other driver didn’t have insurance (or didn’t have enough insurance to cover your damages), or it was a hit-and-run accident, then you would file a UM/UIM claim with your insurance company. UM/UIM refers to uninsured motorist coverage or underinsured motorist coverage. If you file a claim with your insurance company, even though it is your own insurance company processing your claim, the adjusters working the claim are not there to help you, they are there to make the company money. What's the time limit for my case?

How long you have depends on the type of case, and is governed by the Statute of Limitations, which is a law that sets a strict deadline for filing a lawsuit to recover damages. Once this deadline passes, in most cases you will be prevented from filing a lawsuit, although some narrow exceptions do exist. Also, it is NOT recommended to wait until the last minute (when you are only a few weeks from the deadline) before you start looking for an attorney. Many attorneys may refuse to sign up a client who’s deadline is fast approaching, because of the increased risk of malpractice (in the event that the Defendant in the lawsuit cannot be found and served before the deadline passes).
