Working with Carl and his team was an exceptional experience. My husband and I previously established our wills with another firm several years ago. I can honestly say, when it came to drafting my parents’ wills, powers of attorney and advanced directive, the process with Archer Law was much easier, more efficient and reasonably priced. Carl answered my parents’ questions, my sister’s questions and my questions. It was a family event and he could not have been more patient or gracious. Questions & Answers

Banking powers section 2 of P.L. 1991, c. 95 (N.J.S.A 46:2B-11 and 46:2B-13), have these banking powers been revised and if so, how often do eldercare attorneys use the older codes? A POA has access to pay the bills, this is simply legalized theft!

A power of attorney document containing these powers gives an Agent broad authority and should not be granted lightly. In theory, someone can use such a document to the detriment of the principal and so it's a good idea for the principal to know what the document covers before they sign one.

My 88 year old, recently widowed father in law is physically dependent on his son that never left home. He appointed him to be his POA. The drafting attorney added joint bank ownership. Is there a way to stop him from spending down my dad's account?

The answer to this question can be rather complex and fact-sensitive so it's not really possible to answer it here without a consultation and some additional facts. A Power of Attorney document can leave someone vulnerable to theft or exploitation if the document is misused, though, and remedies in general are limited to filing a lawsuit or a police report. Those remedies may in turn not be totally useful.
