filed a unpaid wage claim back in december. finally now 9 months later the update i get was "Your claim has been referred to a manager for review. If the case is complete and approved by the manager, it will be forwarded to the Department’s Hearing Section for the scheduling of a hearing. Due to COVID-19 currently hearings take 18 – 24 months to be scheduled. is this a joke. 2 months ago you told me on the phone it was waiting for review from the manager and try again in 2 months. now youre telling me itll be another 2 years. this cant be serious. is this really how hard my tax dollars work to go after employers who dont pay taxes and dont pay their workers. just seen he was on a nice vacation in flordia though.

I wanted to get an investigation done but the person they assigned gave me paperwork that was riddled with error of critical information (business name, people, etc.).. I told him this isn't right and unlike a normal person he writes back"fill out the paperwork." I called the manager to get a new person to work with and she has the "just try to work with him" when it is pretty clear this guy investigation is going to be clearly of poor quality.. It is ridiculous that upon request I can't GET a new investigator..

Did you fill out a W2 or a 1099 when you started at the temp agency? If it was a W2 you are an employee and should get paid regardless of the payment status with their client. If it was a 1099 then might have to wait until the payment gets to the agency before they pay you. Did you sign a contract when you started working for them? If so, it should have payment terms written out for you.

Long story short, yes. If you are not under a signed contract that spells out your rate of pay or a collective bargaining agreement, you are an at-will employee. Your rate of pay is not guaranteed, neither is your job.

For starters, why are you getting a 1099 and not a W-2?
I'm assuming he neess you to fill out a W-9 online so he can issue you your check and 1099 so he for sure won't have to pay taxes on your pay. As long as you don't fill out the forms he needs, he can hold your check. Its a bad deal, but you need to start off checking to see if he should be giving you a W-2.

They need to know how to bill out your time for each job that you work on as well as know how proficient you are. Are you the boss? No! Do you own the company? No! Without having it spelled out in an employee handbook, it is at the discretion of the employer. Did you call in to request time off? Were you sick and not able to work and told to get a doctors note before returning to work? Could the medical issue be considered personal and not qualify for a proper absence? Are you asking because they reduced your paycheck?
Always communicate through email with your superiors that way you have documentaion.
I did not get paid due to my manager forgetting to approve my time card in time. Can they legally wait to pay me until my next pay check? I get paid every 2 weeks ad now they expect me to go 2 more weeks without pay at know fault of my own.

Definitely need more information, but if you have an employment contract, it may spell out your benefits. Can you ride with the "temps"? Are you a "temp"? Why are you leaving O'Hare? Are you recieving the same wage?
Did you document the shift swap through your manager or HR? I'd start with the union first but I think your co-worker screwed you.
When I asked if you documented it, I meant on paper. It is possible that the shift supervisor was trying to get rid of you.

Was their money owed to the employer for services or products that he has a reason to hold the money. At the least he has to have an accounting for the escrow money and pay back any extra within a couple months of leaving.

Most likely no but if you enjoy your work and want to advance, do as suggested for more opportunities for better wages and jobs. I have a friend who has over 80 days of vacation and PTO accrued which tells the employer that they don't miss work which is highly desirable with an employer.
They probably break the salary down to an hourly rate. For example, if your “salary” was $40,000/yr divide that by 52 weeks in a year and then divide that by 40 hours in a week. You get $19.23 an hour. Did you get an offer letter when you started the job, or have any HR paperwork? That might have your pay rate information.
