In NYC, an accepted offer is not binding on either the buyer or seller until a purchase of sale is signed. Prior to signing this contract, either party can walk away.
In order to submit an offer it is highly recommended that the following three items are included in the offer: (1) a financial disclosure form, (2) a mortgage pre-approval if financed or proof of funds if buying all cash, (3) name and contact info of your attorney.
The seller pays the real estate broker commission. The commission is shared equally by the buyer's and seller's broker.
99% of transactions have attorneys represent both sides of, Buyer and Seller. If you are buying a home in New York, your attorney will negotiate the contract of sale and review all the diligence materials. Your lawyer will read through and summarize the board minutes, building financials, offering plan, house rules and bylaws.
