During your year of separation, every decision you make about custody, support, and visitation, and use of property (such as who is living in the house) sets a precedent for your final order. You need to consult with an attorney before agreeing on those issues, even temporarily and during the year of separation, so that you have full information prior to making decisions that will have such an impact..

Can’t my husband and I just get divorced without a lawyer?

Unless you have no children and no property, this can get tricky very quickly. You need to have an attorney draft your final agreement and the order for the judge to sign. We have helped many clients attempt to fix orders that were entered when they represented themselves. Those orders are not always fixable.

Can I get divorced in 90 days if I can prove my spouse committed adultery?

For a divorce to be finalized, you must have a full and final agreement on all issues (children, support, property) or go to trial on those issues. If you disagree with your spouse on any significant issue, it will take time to work through the court process to resolve those. It will certainly take more than 90 days.
