Questions & Answers

How does the Social Security disability program define “disabled?”

According to the Social Security Act, to be found disabled you must have a “medically determinable impairment” that: • Has already lasted or is expected to last for a continuous period of not less than 12 months or is expected to result in death; • Prevents you from being able to perform past relevant work; and • Prevents you from being able to perform any other substantial gainful work that exists in the economy in significant numbers, considering your age, education and work experience.

Hello, I recently won a wage case that resulted in a $27,000 payment from my former contractor. The payment was split between: $9,000 lawyer's fee, $9,000 w-2 payment, and $9,000 a 1099 payment. How does this affect my Social Security benefits?

Get everything clearly documented. The 1099 and w2 piece will flag with ssa so you must be able to clearly document and demonstrate that the income from 1099 and w2 does not represent *earnings*.
