Left a message regarding a serious matter of a CPS caseworker abusing her power and it had a tremendous effect on several people. No one ever called me back

If you’re dealing with DCP&P and if it’s your niece or nephew that you want to help, deal with DCP&P directly. Make the case that your house is a better fit. Don’t deal with law firms like this. They’ll rob you of your money and you won’t get anywhere. Wouldn’t recommend it because they could have been honest with me with the process instead they milked me for the money. Good news my niece and nephew are with me, with 0 help from this law firm.

What is the difference between legal separation and divorce?

Williams Law Group, LLC | Sep 25, 2020
Williams Law Group, LLC | Sep 25, 2020

In NJ, a legal separation is when spouses decide to live separate and apart from each other without filing for a divorce. Typically this means that parties will reside in separate households and will work out any custody and parenting time issues. A legal separation is not recognized by the Court – instead, parties would have to file for Divorce from Bed and Board which involves filing a Complaint with the Court and the Court would then decide custody, visitation and support issues.

How do courts divide property in divorce?

Williams Law Group, LLC | Sep 25, 2020
Williams Law Group, LLC | Sep 25, 2020

NJ is an equitable distribution state, meaning that there is no 50/50 split. Instead, the courts use an analysis to determine what the assets and property are, and how they should be divided between the parties in the event of a divorce. There is no bright-line rule, and assets will be divided on a case-by-case analysis.

Is there a way to get divorced without going to court?

No. In NJ, in order to get divorced, the parties must appear at least once before the court in the case of an uncontested divorce where the divorce is put on the record.

How much does divorce cost?

The cost of a divorce depends on whether there are complex issues associated with the dissolution of the marriage such as business valuations, complex financial issues, or complex custody issues. The cost to file the Complaint for Divorce is $300.00. There are also other costs associated with a divorce, such as costs for attorneys or mediation. The final costs associated with your divorce depend on how much complex work is involved, as well as how long it takes to come to an agreement on all matters associated with the dissolution of the marriage.

The time frame for completing your divorce depends on whether your case is contested and how long it takes to resolve the issues, but normally the process should not exceed one year. How do I file for divorce?

Williams Law Group, LLC | Sep 25, 2020
Williams Law Group, LLC | Sep 25, 2020

To begin the process in NJ, one spouse must file a Complaint for Divorce with the Court, which includes the names and addresses of the parties, the place and date of the marriage, whether there are any children born of the marriage and their ages, the grounds for divorce (i.e., irreconcilable differences or separation), among other things. The complaint must be filed in the county that you live in, and you must have been a resident of NJ for at least one year prior to filing your complaint for divorce.
