Domestic Violence is broadly interpreted in San Diego county, thus, there are several instances where one spouse may be considered a victim of domestic violence by virtue of their spouse yelling at them, stalking or harassing them, damaging their property, controlling the family finances, or physically shoving or hitting them. Causing the other party to be distraught by virtue of harming the children or family pets is also considered domestic violence and a restraining order may be issued. It is important to know that if a party has a restraining order issued against them a presumption arises under FC Section 3044 that they will lose their rights to custody and visitation of their children until they overcome that presumption.

Yes. If the parties cooperate and each diligently produce their mandatory disclosures to each other and reach a fair settlement between them.
