I am not a lawyer. But florida does not recognise common law relationships, my guess it's his house, still his house. He might have to evect legally. As for the kids you can always ask for child support if they are his. My best guess. Reason I say evict you is. If you rent a room to some one, and want them out, if they don't move out you will have to evict legally.
