I hired attorney Jonathan Feigenbaum to help me with appeal process after my LTD claim was denied by insurance company. He is outstanding and extremely knowledgeable attorney in ERISA and Disability laws. Jonathan evaluated my case, listened to my concerns, and guided me through each step to build a great appeal. He returned my emails promptly and kept me informed every step of the way. My benefits were approved in record time within two weeks after appeal was filed! Job well done!!! If you have been denied LTD benefits and need highly skilled and effective lawyer on your side, then attorney Jonathan Feigenbaum is your man. I am very grateful for Jonathan’s representation and would highly recommend him.

Unless you have an obvious long-term disability, the best time to apply for Social Security disability benefits is 6 to 9 months after you stop working. You do not have to wait a full 12 months from the time you become disabled to apply.
You can continue to receive your long term disability benefits for as long as your plan considers you disabled, or until you have reached your maximum period of payment, whichever comes first. Many plans provide coverage until your normal social security retirement age or age 65.
Long term care provides services for people who have functional limitations and/or long term health conditions for an extended period of time. Services can be provided in a few ways including nursing homes or assisted living facilities, adult day care, home or community based settings, etc. Most long term care is non-skilled assistance such as aid in performing daily activities such as dressing, bathing, using the toilet, eating, etc.
While your disability insurance claim, appeal, or lawsuit is pending, the insurance company may send you for an independent medical examination. The term “independent medical examination” — often referred to as the IME — is a misnomer. A more accurate term would be a “defense medical examination.” IMEs are conducted by physicians who are paid by the insurance company to evaluate claimants. Sometimes insurance companies secure these examinations through outside vendors who act as middlemen between the insurer and the physician. The IME process does not favor claimants. Be cautious about your activities in the days before and after your IME. Insurers often place claimants under surveillance during this time. They hope to catch you doing something strenuous that you’ve claimed you cannot do etc. Here are more tips https://www.erisaattorneys.com/disability-insurance-claim-denied/what-to-do-when-an-insurer-schedules-you-for-an-independent-medical-exam-ime/
Here is a four-step process of filing a claim for LTC benefits. Step 1: Carefully Review the LTC Policy’s Terms Long-term-care policies differ dramatically. If you discover that your loved one has LTC insurance, you should review the policy before you file a claim. While some policies cover any type of facility, including in-home care and assisted living, others will only pay for services at a nursing home. You’ll also want to see if the LTC policy has a waiting or “elimination” period. During this time (which can be up to 100 days), the patient must pay for all of his or her care out-of-pocket. You can request a copy of the LTC policy from your agent or the insurance company. However, some of these policies use highly technical language and are difficult to interpret. If the life insurance policy holder dies within the contestability period, the life insurance company will investigate whether the insured provided accurate information on the policy application. The insurance company has the option of denying payment of the policy death benefit if it can prove that the policy holder made a material misrepresentation or omission. This varies from state to state. In some states, the insurance company must show that the applicant intended to mislead the insurance company.
