A few years ago, I referred a friend of mine to the attorneys at Delfino Green & Green. He was extremely happy with the job they did on his case. The workers compensation process is complex and there are entire books written about how the Workers compensation process works. The process is initiated by the Worker and/or the employer filing a claim after a worker has sustained an injury arising out of their work. Typically, the worker then seeks treatment through a network of physicians and other medical professionals provided by the employer's Workers Compensation insurance company. From there, the injured worker and/or the insurance carrier will file an application for adjudication of claim with the appropriate Worker's Compensation Board. While that process can be fairly quick and straightforward, quite often moving your case towards resolution is quite involved and requires a high level of expertise in terms of legal representation and medical testimony.

When you are injured at work, you have the right to claim compensation in the form of temporary disability (missed wages), medical treatment and other expenses because of your injury. Medical treatment for your injuries is paid for by either your employer's workers compensation insurer or the employer themselves if they are self insured. There really are no limitations on the types of injuries that qualify for workers compensation benefits so long as the injury is "industrial," that is, it arose out of your employment. Injuries range from fairly minor, temporary injuries to catastrophic and permanent injuries and even death. Although it might seem at first blush that getting the benefits you are entitled to is a fairly straightforward process, it is not. The first thing you need to do is hire a good personal injury attorney. That attorney will thoroughly investigate your case, gathering all of the information and records relating to liability (who is at fault for your injury and why) and damages - what types of injuries did you suffer and what is the value of the losses and harms. Oftentimes, your attorney will advise you to wait for some period of time before filing to have a better idea of the extent of your injuries and damages. Once the attorney has facts showing both liability and damages, then a lawsuit is filed. Some personal injury lawsuits settle quickly, but most do not settle for full value until they have been properly worked up for trial. Unfortunately, this is not a quick process. However, if you have a good lawyer, most cases will settle shortly before trial, but only if you're completely ready for trial!

Under California law, if another person or entity (Corporation, Government entity, etc.) negligently or intentionally causes you loss, harm, or damage, you have a right to bring a civil lawsuit against them. Your claim might include financial losses. These are typically things such as medical bills for the past or future care you received, lost wages if you missed work because of your injuries, lost future income if your injuries will prevent you from working or even earning as much income in the future. California law also says that the damages can also include what are called "pain and suffering" damages for the physical pain and emotional distress that you experienced in the past and that you will experience in the future.

The answer is "maybe." If you were injured and it was someone else's fault, then you have a case. Even if you were partially at fault in the accident, you may still be able to recover something since California is what is called a "comparative fault" state. In simple terms, that means each party is responsible for their own percentage of fault. For instance, if you are 50 percent at-fault and the other driver is 50 percent at fault, you can recover 50 percent of your total damages from that other at-fault driver.
