It depends. If you file a demand for a formal review hearing to contest the administrative suspension within 10 days after the arrest, the "on the spot" suspension can be invalidated at the hearing. If you do not win that hearing, then it is a 12 month suspension (30 day hard) if you took the breath test, or a 12 month suspension (90 day hard) if you refused, or a 18 month hard suspension if you refused and this was your second refusal. In court, if you are convicted of DUI, you are facing a five (5) year revocation if this DUI was within 5 years of a prior DUI. If the prior conviction was outside of 5 years, then the second DUI conviction is treated the same as a first DUI with a 6 month to 12 month suspension (except this time you won't qualify for a hardship license).
Yes, if the merchant is actually owed money for goods or services then the merchant can sue the client. Although it is probably unlikely since the merchant didn't even bother to respond to the financial institution which would have been eaiser.
