Alicia, Nothing. There is no administrative suspension of the driver's license with a BUI. Also, the statute does not provide for a court ordered suspension of the driver's license if you are convicted in court. However, the law does provide for an "on-the-spot" civil penalty for refusing the breath test of $500 (which your criminal defense attorney should contest in a hearing before the trial court within 30 days of the arrest). See Florida Statute Section 327.35215. A second refusal is a crime so we ALWAYS demand a hearing to invalidate the civil penalty within 30 days of the arrest. Many BUI cases are reduced to a civil infraction for "careless boating" which allows you to avoid many of these consequences.
