2 years, or in some cases 3 years.

I resigned two days ago but my employer did not include my accrued PTO hours from January to August totaling 70 hrs. Per H R Department I can only get my PTO hours on my anniversary month which is January and they don’t prorated it. Is that legal?

You need to lawyer up. You only get 30 days, of interest. For unpaid wages. In bakersfield you dont have any chance, even if you prove that you have pto you will not get it there. Dont waste your time looking for someone higher than the dol. If you do, good luck office of inspector general cant help you either. IRS doesnt get involved in little cases.
