Hi Tamara, It all depends on the language of the trusts. If both of them have provisions regarding the same contents in the home, I would assume the one executed later would govern; however, I would not be able to tell you for certain until we have reviewed the documents. Yes, a person is not required to accept the duties of an executor or trustee. It is voluntary.
An executor is most typically designated in person’s will: he or she is often someone that the deceased person trusted to manage the estate fairly and efficiently. However, in cases where a will is not present, a court will likely appoint an executor for the estate.
