I’m so grateful to have Sean and his office represent me through my divorce. They helped me through a very difficult time where all I could do is worry about the worst. They were confident and professional in taking on my case and were always there for me whenever I had any urgent needs and questions. The outcome of my case ended up being the best scenario for my family and me.

I've worked with Sean for several years. I've mediated dozens of cases with him. He is always prepared, professional and compassionate with his clients. I cannot recommend him enough.

Highly recommend! I cannot say enough good things about Sean Smallwood and his team! They were amazing to work with! They always put my best interest and my daughter’s best interest first. They took the time to talk to me and understand my situation to formulate a strategic plan of action. I’m so grateful for this firm!

Wow I can’t say enough great things about Sean Smallwood & his office. I’m still in shock how wonderful everything happened in my court case, and I owe it all to Mr. Smallwood. I literally don’t know what I would have done without him, & I’m positive that without him, my situation would have ended up in a whole other direction and because of that I’m so grateful. If you’re looking for a family law attorney that not only knows his stuff (& it really shows in the courtroom), but really cares, I would say look no further! You found him... Give him a call, you won’t regret it. He really is an extraordinary attorney & human being. Very grateful!

Questions & Answers

If my wife and I are in agreement on everything for our divorce can we hire you to be our attorney? We live in Orlando Florida.

In Florida a divorce lawyer cannot represent both you and your wife as that would be a conflict of interest. The attorney can only represent one of you. This means that we would not be able to give any legal advice to the other party, but we would be able to draft settlement documents for the both pf you to review and sign.

How much does it cost to file for divorce in Florida? What if I cannot afford that fee? Do I have to stay married?

In Florida when your divorce is filed through the Florida e-filing portal (most common) the fee will be $408.00. If you cannot afford this fee you can fill out an application to waive this fee, but this will need to be approved by the Clerk of court.

What Kind Of Fees Do You Charge?

The Florida bar permits divorce and family lawyers to collect fees from their clients in a number of different ways that can be generally grouped into one of two different categories, refundable and nonrefundable. By far, the most common type of fee that is charged by divorce attorneys in Orlando Florida is the non-refundable fee. This is because nonrefundable fees require less bookkeeping and are guaranteed profits for the attorney. We do not charge our clients nonrefundable fees unless this is something that the client specifically requests. Our preferred fee structure is a refundable fee structure where the client commits to maintain a more reasonable balance in the law firm’s account at all times throughout the case. If and when for any reason the representation concludes the firm prepares a final billing statement and whatever funds are remaining on account with us are refunded to the client’s card.

Greetings! is this a new case with a different child? If it is regarding the same child then your employer may be deducting your pay for an out dated income withholding order in addition to a new one.

The Father has always had physical custody of the child. The Mother file for child support 2 weeks ago. He still has the child and the child is registered in school from the Father's home and has always had..the child is 6 now.

Sounds like the mother may have provided some incorrect information on an application for state aid and now the department of revenue is coming after dad for support. Not a bad idea to call the department of revenue and and let them know about this. If they come after dad to set a hearing just have plenty of proof of how long the child has lived with dad.

Wat can i do if the kids are over 21 an the mom still wants child support

child support only runs in FL until age of 18. However, if there is delinquent support that was not paid then mom can still go after that in addition to any late interest penalties that have accrued.
