With the other driver not cooperating with their insurance company, your only beneficial recourse is filing a civil suit against that driver.
Please remember that anytime you file a claim with your insurance company, whether they subrogate and get reimbursed or not, it is a claim on your insurance. There are no laws in Illinois that say an insurance company can't non-renew your policy at the next policy anniversary for a claim. Always try to get the other person's insurance to pay. You can also file a complaint online with the Department to try to get the insurance company to pay your claim. It's free.
Your insurance company should be dealing with his. In the mean time your insurance should pay to fix your car then get their money back on the back end.
