Usually the individual would be evaluated by a psychiatrist for that local area. If person was deemed incapable of standing trial they would be moved to a psychiatric treatment facility. At the psychiatric treatment facility they would be evaluated and a team would work to get them on appropriate medication and to stabilize their crisis at which time they would be transferred back to the county their crime was committed to stand trial or possibly be released depending on what the judge orders. Psychiatric treatment facilities are not day spas. Wards are locked and movement around grounds is restricted to certain hours and for group activities and counseling and is usually supervised by staff all State psychiatric treatment facilities are smoke-free facilities and 1 step down from jail. Not a place you want to try to go to avoid having to go to jail if you are caught faking a psychiatric crisis you will be sentenced to your original charge Plus charges for malingering.
