Not if it's alcohol. In NYC, it's against the law to have alcohol out in public in an open container. You can actually get a civil summons (aka a ticket) and have to pay a $25 fine.

If it's alchollic, legally, no. It's not a restaurant policy but a NYC law. Even liquor stores have to put your unopened purchases in a brown paper bag or black/opaque bag.
