You would have to sue them for the court cost, you suing is your decision. But the judge will sometimes grant if you ask for it on the petition.

If you sue, and win, the losing party pays court costs. If it is worth your time is another question. Also, you may have them at the courthouse where they live. If they have moved far, it becomes expensive really fast.
